James S. Rollins is a partner in Nelson Mullins Riley & Scarborough's Boston office. He has considerable experience in securities litigation and focuses his practice on the representation of financial institutions, including broker dealers, investment management firms, hedge funds, and banks; in securities regulatory and enforcement defense; and in disputes arising with principals, investors, and employees. Mr. Rollins also handles general commercial litigation, creditors' rights and bankruptcy, and intellectual property matters, as well as First Amendment and related issues in which he represents publishers, broadcasters, and individuals.
Among the matters in which Mr. Rollins has been involved are:
- Served as a national coordinating counsel for a major New York-based broker dealer in connection with multimillion-dollar fraud claims arising from a prominent research analyst's work brought through more than 100 arbitrations and successfully tried or otherwise resolved many as lead counsel.
- Defended a major Boston-based insurer, its affiliated broker dealer, and its registered principals in a month-long NASD arbitration in which a former senior registered representative claimed wrongful discharge and related fraud following discovery of his operation of an unregistered investment bank. After a full hearing, the panel dismissed the $42 million claim and recommended its expungement from the principals' records.
- Represented a Boston-based investment management firm in claims brought by the SEC and several state regulatory authorities arising from alleged improper market-timing by some of the firm's customers and alleged related deficiencies in the firm's fund disclosures. This matter was successfully resolved through negotiation and regulatory enforcement proceedings.
- Represented a UK software company in AAA arbitration, prosecuting its contract and related IP claims against a U.S. firm. Mr. Rollins obtained and enforced an award against the U.S. firm after a month-long hearing.
- Successfully prosecuted contested bankruptcy matters in several jurisdictions on behalf of secured creditors to resolve terms in chapter 11 plans, deny debtors' use of collateral, recover collateral for creditors and deny individual debtors' discharges based upon fraud.
- Counseled several financial institutions on their employment policies and practices and handled related employee claims through hearings and trials before agencies and in courts as well as through private arbitration.
- Represented several major newspapers in a case that recognized their right to seek and obtain publicly filed case records in sex abuse cases after those cases were settled.
- Represented a major bank in a case that overturned the Connecticut Banking Commissioner's prohibition of ATM use fees.
Mr. Rollins is a member of the Securities Industry and Financial Markets Association's Compliance and Legal Division; The American Society of International Law, the American Bar Association and its Business Law, International Law and Practice, Labor and Employment Law and Litigation Sections as well as its Communication Law Forum; the Connecticut Bar Association and its sections on International Law (of which he is a former chair and current vice chair), Commercial Law and Bankruptcy, Federal Practice and Labor and Employment Law; and the Hartford County Bar Association.
Mr. Rollins is a board member of and counsel for Lawyers Without Borders, Inc., the world's largest globally oriented group of volunteer attorneys who support nonprofit organizations, Rule of Law initiatives, legal capacity building projects, and human rights work around the world. Among his community activities, Mr. Rollins is a board member of Massachusetts Correctional Legal Services and was a founding board member and counsel for Seacoast Academy, an independent day school in New Hampshire, and a board member and counsel for New Haven Sister Cities, Inc. He is also actively involved in the Princeton University Alumni Council.
Mr. Rollins is admitted to practice in Connecticut and the U.S. District Courts for the Districts of Connecticut and Colorado.
He earned his Juris Doctor in 1989 from the University of Virginia School of Law and earned an A.B., cum laude, in 1984 from Princeton University.
