Jane T. Davis is a partner of Nelson Mullins Riley & Scarborough LLP in Charleston where she practices primarily in the area of pharmaceutical and medical device litigation.
Ms. Davis has been defending drug and medical device suits since 1991, after having narrowed her more general product liability and insurance defense practice to use her background and prior professional experience as a pharmacist. During the ensuing years, Ms. Davis has defended a variety of individual drug and medical device suits and has coordinated state proceedings and federal multi-district litigation. She has also been involved in coordinating the defense of drug litigation nationally. Additionally, Ms. Davis has handled the defense of professional negligence claims on behalf of laboratories and pharmacists, and has been involved in the defense of toxic tort actions.
Ms. Davis has defended cases involving over-the-counter medications, anticoagulants, analgesics, anti-inflammatories, anesthetics, bronchodilators, intravenous pumps, implantable contraceptives, intrauterine devices, silicone breast implants, angioplasty devices, intestinal catheters, latex gloves, durable medical equipment, and joint replacements. She has experience in defense of cases involving the adequacy of warnings, drug/drug interactions, revisions to prescribing information, recalls, contamination, adequacy of design, and the proper choice of materials.
Ms. Davis has dealt with numerous legal issues, including preemption and the admissibility of expert testimony, and she has obtained summary judgment by successfully excluding the plaintiff's expert witness on Daubert grounds. Ms. Davis has handled trials and deposed plaintiffs, co-defendants and plaintiffs experts. She has defended the depositions of company witnesses and has extensive experience in locating, retaining and working with defense experts.
She is the author of "Mission Not Impossible: Finding Niche Medical & Scientific Experts," Rx for the Defense, Jan. 21, 2010; and co-author of "Take Advantage of New Expert Rules Now," Law 360 Product Liability Law, Feb. 23, 2010; and "Preemption in Nonprescription Drug Cases," For the Defense, DRI, July 1, 2009.
A member of the South Carolina Bar, Ms. Davis is admitted to practice before the 4th U.S. Circuit Court of Appeals and the U.S. District Court for the District of South Carolina. Ms. Davis currently is a member of the American Bar Association, the American Society for Pharmacy Law, the Defense Research Institute, and the South Carolina Defense Trial Attorneys' Association. She is a permanent member of the U.S. Fourth Circuit Judicial Conference. Ms. Davis served as law clerk to Judge Clyde H. Hamilton of the U.S. District Court for the District of South Carolina from 1986-87, and for U.S. Magistrate Cameron M. Currie from 1985-86.
In 2005, Ms. Davis was elected to the Product Advisory Council Inc. (PLAC) in recognition for her work in product liability defense.
Ms. Davis earned a Juris Doctor from the University of South Carolina School of Law in 1985, and a Bachelor of Science in Pharmacy from the Medical University of South Carolina in 1982.
