Richard B. Herzog is a partner of Nelson Mullins Riley & Scarborough LLP in Atlanta where he leads the Atlanta office's debt finance and restructuring practice.  
 
Mr. Herzog, a business bankruptcy and lending lawyer, has represented the official committee of unsecured creditors and trustee of a $100 million textile manufacturer; represented a Fortune 50 company in the defense of a $450 million breach of contract suit brought by the litigation claims representative of a bankrupt diaper manufacturer, and has represented holders of in excess of $100 million in debt in a variety of Chapter 11 cases involving multi-location retailers, nursing homes and trucking. He has represented lenders in out of court workouts of debt facilities in excess of $100 million in industries as diverse as long term acute care hospitals, extraction and transportation.

He also has substantial practical experience in real estate workouts, foreclosures, bankruptcies and litigation, having practiced through every real estate down turn since 1979, and been involved in resolution of many of the largest defaults in that time. He regularly represents special servicers in resolving commercial mortgage-backed securities matters, as well as money center, regional and community banking institutions with problem real estate loans and relationships.
 
Mr. Herzog is a past President of the Atlanta Bar Association where he served as an officer or director since 1998. He also served as an officer and director of the Bar’s Bankruptcy Section from 1991-98. Mr. Herzog is a member of the American Bar Association and the State Bar of Georgia. He has been a trustee of the Georgia Legal History Foundation since 1988 and served as an officer in the State Bar of Georgia Author’s Court from 1989-93. Mr. Herzog is a Charter Life Fellow of the Atlanta Bar Foundation, a Fellow of the Georgia Lawyers Foundation, a Life Fellow of the American Bar Foundation and a member of the Old Warhorse Lawyers Club.
 
He is an experienced speaker at CLE seminars on bankruptcy, foreclosure, and the Uniform Commercial Code. Mr. Herzog is the author of Bankruptcy: A Concise Guide for Creditors and Debtors, Arco Publishing Co., NY, a 1983 Fortune Business Book Club selection. From 1979-81, Mr. Herzog served as law clerk to Judge W.H. Drake of the U.S. Bankruptcy Court for the Northern District of Georgia. 
 
Mr. Herzog is annually included among the State’s Legal Elite by Georgia Trend Magazine. He has appeared in Atlanta Magazine as a Georgia Super Lawyer and one of the 100 Best Lawyers in Georgia. International legal publishers Chambers and Partners recognized him as a notable practitioner in bankruptcy/restructuring in its Chambers USA 2007-2011 editions, and The Atlanta Business Chronicle listed him as Who's Who in the Atlanta Power Book.
 
Mr. Herzog earned a Juris Doctor, cum laude, from the University of Georgia in 1979 and a Bachelor of Arts in Political Science from the University of Georgia in 1970. He served in the USNR from 1970-1976.
 
Mr. Herzog is also active in community affairs. In 2004 he was given a Special Recognition Award by the DeKalb Medical Center Foundation where he has served as a trustee since 1995. He also serves on the Board of Directors of John Marshall Law School and has served on the Board of Trustees of the Temple. 
 
He is married to Dr. Laura Kibler-Herzog, a chemistry professor at Georgia State University, and has two children: Allison, 17, and Jeffrey 12, who attend City of Decatur Public Schools.
