R. Ross Burris, III, is partner of Nelson Mullins Riley & Scarborough LLP in Atlanta where he practices healthcare and life sciences law and litigation.

Mr. Burris focuses his practice on litigation and healthcare regulatory issues and represents a wide variety of healthcare organizations, including hospitals and health systems, long term care providers, ambulatory surgery centers and physician groups.

Representative matters include:

  • Represents healthcare clients in complex commercial disputes and in federal and state court actions
  • Represents healthcare clients in arbitration disputes and mediations
  • Advises and represents hospital systems and physician practices in privacy matters, including litigations concerning HIPAA and patients' protected health information and peer review records
  • Represents hospital systems in actions related to EMTALA complaints
  • Represents healthcare clients in responding to subpoenas and civil investigative demands from government agencies
  • Represents healthcare clients in obtaining injunctions against government agencies
  • Represents hospital systems in class action litigations
  • Advises and assists hospital systems on physician recruitment issues
  • Advises hospitals and physicians on employment contract issues
  • Represents healthcare clients in actions related to the enforceability of noncompetition and nonsolicitation covenants
  • Advises and represents health systems in claims arising out of the denial or limitation of medical staff privileges
  • Advises and represents physician practices in shareholder and physician employment disputes
  • Advises and represents hospital systems and nursing homes in matters related to disruptive patients, guardianships, temporary healthcare placement decision makers for patients and case management issues
  • Advises and represents hospital systems and physician practices on lease issues related to medical office buildings, including compliance with applicable regulations
  • Assists health care clients in OIG/DOJ civil fraud investigations
  • Conducts due diligence reviews related to healthcare regulatory compliance issues for private equity firms

Mr. Burris regularly speaks at seminars on privacy matters, the release of protected health information, and peer review processes. Mr. Burris also lectures about, and has published materials on, the Georgia Open Records Act.

He is admitted to practice before the Georgia Court of Appeals, the Georgia Supreme Court, and the U.S. District Court, Northern District of Georgia.

A member of the American Health Lawyers Association, Mr. Burris also is a member of the Georgia Academy of Healthcare Attorneys, the Lawyers Club of Atlanta, and the State Bar of Georgia's Health Law Section and the Young Lawyers' Division.

Mr. Burris is involved in the local community and is currently serving on the host committee for Camp Dance, a benefit to raise money for Camp Twin Lakes in Rutledge, Ga. Camp Twin Lakes provides places and paths for children with serious illnesses and life challenges to experience the joys of camp and grow in their confidence and capabilities. Mr. Burris also is active in the pro bono community and has worked with the Atlanta Volunteer Lawyers Foundation and Project Liberty.

Prior to entering private practice, Mr. Burris served as a prosecutor, where he gained strong trial experience. In 2001, he earned a Juris Doctor from the Mercer University Walter F. George School of Law. In 1998, he earned a Bachelor of Arts from the University of Georgia.
