Sean R. Higgins is an associate in Nelson Mullins Riley & Scarborough's Boston office, where he practices in the areas of business and consumer finance litigation. Presently, Mr. Higgins's litigation practice focuses on consumer finance, banking, and general business disputes.

Mr. Higgins has experience representing both plaintiffs and defendants in business and commercial disputes, involving real estate, housing, construction, bankruptcy, toxic torts, medical malpractice, and personal injury. He has trial experience in both state and federal court, as well as arbitrations and mediations. He also has appellate experience in the Massachusetts Appeals Court, the Supreme Judicial Court, the Connecticut Appellate Court, the Supreme Court of Connecticut, and the United States Court of Appeals for the First Circuit.

Some of his representative cases include:

  • Obtaining dismissal in the United States Court in Massachusetts of complaint alleging violations of Home Affordable Mortgage Program, violations of Massachusetts Consumer Protection Act, and violations of state common law on behalf of HSBC;
  • Successful appeal to the Connecticut Supreme Court, where court issued a comprehensive opinion as to the current state of Connecticut's public policy as to gambling and overruled a 1947 case that had been the primary controlling case for gambling disputes in that state;
  • Handling a multimillion-dollar settlement in Massachusetts Superior Court in an action involving allegations of nursing home abuse;
  • Obtaining a $275,000 settlement in United States District Court for the Northern District of Texas in a business dispute involving fraud and misrepresentation;
  • Negotiating a multimillion-dollar commercial agreement between numerous parties for the purchase and sale of a HUD subsidized and insured apartment complex on behalf of a property owner;
  • Representing a restaurant lessor-buyer in a commercial lease-purchase transaction where the client obtained a profitable ongoing business with turnkey change of ownership; and
  • Obtaining dismissal of claims on behalf of lender in state court action brought by plaintiff seeking to set aside and invalidate mortgage.

Mr. Higgins is admitted to practice in the Massachusetts, Connecticut, West Virginia, the U.S. Supreme Court, the United States Court of Appeals for the First Circuit, the U.S. District Court for the District of Massachusetts, the U.S. District Court for the District of Connecticut, and the U.S. District Court for the Southern District of West Virginia.

He is the author of "Proving Copyright Infringement: Will Striking Similarity Make Your Case?" Suffolk Journal of Trial & Appellate Advocacy, Volume VIII, 2003.

Before joining Nelson Mullins, he was associated with two other Boston law firms. He also has served as general counsel for a physicians' medical practice group.

Mr. Higgins earned his Juris Doctor in 2003 from Suffolk University School of Law, where he was executive director of the Moot Court Honor Board, a staff member of the Suffolk Journal of Trial & Appellate Advocacy, and was on the Dean's List. He earned a Bachelor of Arts in Economics and Political Science from Assumption College in 1999.
