Stephen D. Martin, a partner of Nelson Mullins Riley & Scarborough LLP, practices in Raleigh in the areas of business litigation, product liability, and health care law.
Since joining the Firm in 2005, Mr. Martin has been significantly involved in complex litigation in federal court, including representation of clients in trade secret misappropriation, unfair or deceptive trade practices, and trademark and copyright matters. Mr. Martin has also represented clients in federal preemption matters and Section 1983 matters. In the North Carolina state courts, Mr. Martin has represented clients in defending product liability actions involving pharmaceuticals and medical devices, trucks, and food products, and in breach of contract actions involving employment contracts, insurance contracts, and sales contracts.
Mr. Martin also has a significant health care litigation practice, including defending a Medicaid managed care organization in complex federal litigation against federal due process claims and Americans with Disabilities Act challenges. Mr. Martin has also represented a durable medical equipment provider in its efforts to be enrolled in the North Carolina Medicaid program. Mr. Martin also successfully represented an out-of-state air ambulance company in a case in which the federal court found North Carolina's CON law to be preempted by federal law, freeing the company to operate in North Carolina.
A member of the State Bar of North Carolina, Mr. Martin is admitted to practice before the U.S. District Court for the Eastern, Middle and Western Districts of North Carolina as well as the Fourth Circuit Court of Appeals. Mr. Martin is also a member of the District of Columbia Bar, and is licensed to practice before the Court of Appeals for the District of Columbia.
Mr. Martin is also a member of the bar of the United States Court of Appeals for Veterans Claims, where he has represented several pro bono clients in the appeal of the denial of veterans’ disability benefits. Mr. Martin’s other pro bono work includes serving as a Guardian ad Litem in child custody cases before the North Carolina Court of Appeals.
Mr. Martin earned a Juris Doctor from Northwestern University School of Law in 2002 with concentrations in Civil Litigation and Dispute Resolution, and in Law and Social Policy. Mr. Martin earned a Bachelor of Arts, summa cum laude, in Politics and Government from Ohio Wesleyan University in 1997.
