S. Wade Malone is a partner of Nelson Mullins Riley & Scarborough LLP who practices in Atlanta in the areas of business litigation and product liability defense. A member of the State Bar of Georgia, Mr. Malone is admitted to practice in all courts in Georgia, before the U.S. Court of Appeals for the Eleventh Circuit, and the U.S. District Courts for the Northern and Middle Districts of Georgia.
Mr. Malone’s litigation practice includes representation of both plaintiffs and defendants in a broad range of complex litigation in both state and federal courts throughout the United States, including business, intellectual property, antitrust, restrictive covenant and construction litigation. In two recent cases, he successfully argued appeals in both the United States Courts of Appeals for the Ninth and Eleventh Circuits in cases involving complex business disputes. Mr. Malone is a Certified Mediator.
Mr. Malone has been selected by his peers as a Georgia “Super Lawyer” in Business Litigation for the years 2003-2011, inclusive. He has also been selected by Georgia Trend Magazine as a member of their “Legal Elite” in Business Litigation.
In 2003-2004, Mr. Malone served as the 96th president of the Atlanta Bar Association, the largest voluntary bar in the Southeast, with more than 6,300 members. During Mr. Malone’s term as president, the Atlanta Bar Association had its greatest increase in membership in its 116 year history. He served in the House of Delegates of the American Bar Association as a representative of the Atlanta Bar Association from 2005-2011. Mr. Malone has served on the boards of directors of the Atlanta Bar Foundation, the Atlanta Legal Aid Society, the Atlanta Volunteer Lawyers Foundation, and Kids In Need of Dreams, Inc. He served as president of the Atlanta Legal Aid Society in 2001. In 1998, Mr. Malone received the Charles E. Watkins, Jr. Award from the Atlanta Bar Association for sustained and distinguished service to the Bar. He was the youngest recipient in the award’s history. Since its inception in 1993, he has been co-chair of the Atlanta Bar Association’s Summer Law Internship Program which provides paid internships for Atlanta area high school students. In 2009, Mr. Malone received the Atlanta Bar Association’s Leadership Award, which recognizes lawyers who “inspire by their example, challenge by their deeds, and remind us all of our debt to our profession and our community.”
Mr. Malone served on the Atlanta City Board of Ethics from 1999-2002, and was chairman from 2001-02. In 2005, he was selected by the judges of the United States District Court for the Northern District of Georgia to serve on the Northern District of Georgia’s ten-lawyer Bar Council. Mr. Malone presently serves as Chair of the Bar Council’s Disciplinary Committee.
In 1986, Mr. Malone earned a Juris Doctor, with honors, from the George Washington University of Law School. During law school, he was a member and an editor of the George Washington Journal of International Law and Economics. Mr. Malone earned a Bachelor of Arts in Government, cum laude, from Georgetown University in 1983 where he played baseball. Mr. Malone is married to Kelly Malone, an attorney. They have three teenage children.
